Here are the regulations of the Consumer Council. The regulations were laid down by Royal Decree of 5. April 2002 and put forward by the Ministry of Children and Family Affairs.

§ 1. The Consumer Council’s object

The Consumer Council’s object is to work for increased consumer influence in the community, to contribute to a consumer friendly development, and to promote actions that can improve the consumers’ position.

§ 2. Duties

The Consumer Council’s main duties are to protect the consumers’ interests by among other factors to:

  • exercise influence upon authorities, organizations and trades
  • train the consumers through information, advices and guidance, and
  • render assistance to consumers

The Consumer Council shall contribute to make consumer questions an item on the agenda of the social debate

§ 3. Status and organization

The Consumer Council is an administrative body with special authorities.

The Consumer Council takes an unrestricted and independent stand in consumer policy questions. The organization’s administrative authorities also appear from § 9.

The Consumer Council shall be independent of commercial interests and other organizations.

The Consumer Council is administered by a Board (see § 5).

The Director is in charge of the day-to-day running of the organization and is responsible to the Board (see § 6).

A forum for consumer policy (see § 7) is in an advisory capacity in relation to the Consumer Council’s board.

§ 4. Financing

The Consumer Council is granted a basic funding from the Government.

The Consumer Council may carry on income-producing activities to the extent they are consistent with the organization’s independent position.

§ 5. The Board of administration

§ 5.1 Appointment and composition

The Consumer Council’s Board of administration consists of 7 members: a chairman, a deputy chairman and 5 members. The 5 board members have personal deputies.

Chairman, deputy chairman, board members and deputy board members are appointed by the Ministry of Children and Family Affairs for a 4-year-period, with the possibility of renewed appointment for one period.

4 board members are appointed according to proposal from the consultative consumer forum (see § 7). 1 member is appointed according to proposal from the Consumer Council staff.

Upon constitution of the Board it should be emphasized that the Board shall hold both financial/administrative and consumer political competence

When appointing the director 1 extra representative from the staff shall join the Board.

The Ministry decides on an annual remuneration for the board members and its chairman.

If the Ministry concludes that the Board fails to exercise financial responsibility, it can replace members of the Board.

§ 5.2 The Board’s responsibility and duties

The Board has the overall responsibility for the consumer-political and administrative management of the Consumer Council. The Board shall ensure that the organization is run in an appropriate and efficient manner in accordance with the object and duties stated in these regulations’ §§ 1 and 2, and within the scope of the activity, cf. notably §§ 4 and 9.

The Board’s principal duties are further to:

  • map out the main lines, make strategic decisions and adopt plans for the Consumer Council’s activity
  • deal with relevant matters and questions relating to consumer policy
  • approve of draft budgets for the Consumer Council’s activity, and advance budgetary recommendations to the Ministry- make decisions about the management of the Consumer Council
  • take responsibility for the follow-up of results and to keep a check on the use of funds and income flow as compared to the budget
  • submit reports pursuant to Regulations for Financial Management in the Government Administration and instructions laid down by the Ministry
  • submit each year a report on the activity in the form of an Annual Report

§ 5.3 The Board’s rules of procedure

The Consumer Council’s board holds a meeting at least 6 times annually, and beyond that when at least 3 of the members insist on having a meeting

The chairman gives notice of the meeting. The notice with agenda and other documents shall be passed on to the members of the board and the deputy members well in advance of the meeting, at least one week.

The Board forms a quorum when at least 4 of the members, among whom the Chairman or the deputy chairman, are present. The vote of the Chairman counts double when there is an equality of votes. If a member has lawful absence, the personal deputy shall be called in.

The Consumer Council’s director takes part in the Board’s meetings and is within his rights to speak.

Minutes of the board meetings shall be kept. The minutes are being sent to the Ministry, along with the case papers for the Board’s resolutions, in the way they were presented to the board members.

§ 6. Director

The Director is appointed by the Consumer Council’s board. The appointment is for a term of 5 years.

The Director is at the head of the daily administrative and technical management of the Consumer Council, and is responsible to the Board. The Director shall see to it that the Consumer Council is run in accordance with these regulations, financial and administrative set of rules ordained by superior authority and the Board’s decisions.

The Director shall provide for:

  • preparation of plans and budgets
  • preparation of matters for the Board’s meetings, and see to it that the Board is kept informed of affairs of importance to the organization’s activity
  • discussion and follow-up of current matters and questions related to consumer policy
  • that the organization manages to keep within the limits of the budget
  • reporting to the Board
  • notice of and preparation of meetings in the Forum for consumer policy
  • that the organization is run in accordance with regulations applicable to government service

The Board shall give more precise directions for the Director’s duties.

§ 7. Forum for consumer policy

§ 7.1 Representation, appointment

The Consumer Council’s board calls in a consultative forum for consumer policy, consisting of up to 25 representatives from authorities (including supervisory bodies), research institutes and organizations (including trade associations). The representatives of the forum should have his/her personal deputy.

The Consumer Council’s board decides what organizational units will be invited to propose representation. One should aim at a balance between various interests, the composition should vary over time, and it should involve geographical/regional differentiation The representatives of the forum are appointed by the Consumer Council’s board for 2 years. Reappointment can be made only once.

The composition shall at any time be in accordance with the requirements of the Act on equality of status.

§ 7.2 Partaking and duties

The Forum shall have a consultative function towards the Board in connection with questions on consumer policy.

The Forum shall give a statement on the Consumer Council’s strategy and plans before they are adopted by the Board.

The Forum proposes to the Ministry candidates for 4 members (with personal deputies) of the Consumer Council’s board.

The Consumer Council’s board can submit questions on consumer policy to the Forum for its opinion. The Forum can also take up matters and make statements on own initiative.

The Forum can furthermore initiate conferences or hearings, and take part in such arrangements in cooperation with the Consumer Council.

§ 8. Organization

The Consumer Council’s organization is administered by the Director.

The Consumer Council’s contact with the consumers is attended to through local or regional offices.

The Ministry lays down the procedure rules for appointment of the Consumer Council’s employees.

§ 9. Authorities

The Consumer Council has been given exemption from the Regulations for Allocation Management in the Government Administration, § 4. The Consumer Council is with that not comprised by the gross budgeting principle for public activity and administers itself its earnings. Rules for the management of finances are laid down by the Ministry.

The Consumer Council’s board makes decisions concerning the organization of the activity.

Major structural changes in the Consumer Council’s organization are submitted to the Ministry for final decision.

The Consumer Council establishes and stops posts and makes employments itself within the given lump sum allocations.

§ 10. Regulations

The Consumer Council’s regulations are laid down by Royal Decree. Proposal for amendments of the regulations shall be submitted to the Consumer Council’s board for its opinion.

§ 11. Reporting

Reporting shall be done pursuant to Regulations for Financial Management in the Government Administration.

§ 12. Entry into force

These regulations come into force 1st of July 2002.
